PREDICTIVE DIALER POSTINGS.
01.05.10-the ftc released two more reports to
congress this week: (1)a one-time report on
enforcement efforts and consumers' perceptions of
the registry's effectiveness (the enforcement
report); and (2) a biennial report focusing on the
use of the dnc registry by both consumers and
businesses, as well as the impact that new
technologies have had on the registry (the tech
report) . summary, 61 telemarketing cases alleging
dnc violations, 48 resolved with final court orders
requiring payment of nearly $21 million in civil
penalties and $12 million in redress or
disgorgement. the ftc has determined ther is no
evidence indicating telemarketers have targeted
senior citizens or immigrant communities. as for
the fcc, they have settled only four dnc
investigations since 2003 with c onsent decrees
providing for payments totaling $1,490,000. the fcc
has also issued over 1,000 warning citations to dnc
violators since 2003. the ftc has robo calls in
their crosshairs with 18 actions against entities
using robocalls for mass telemarketing. with just
six civil penalty actions concluded, the judgements
require civil penalty payments totaling over $9.4
million.
08.31.09-new ftc restrictions for
telemarketers using automated, pre-recorded
messages or so called robocalls take effect
tomorrow. these robocalls to consumers are
dangerous at best, even with newly required advance
written permission.
07.31.09-i was saddened this week to hear of the
passing of benny mabone. benny was a true gentleman
and an old pal who always treated me like a son. he
taught me a lot about honesty and integrity. benny
will be sorely missed by all who knew him. benny
mabone spent his final days in marietta,
ga.....
07.25.09-(compliance news) the ftc has amended its
complaint against a sender of robo-calls. the
agency had previously frozen the assets of the
company and obtained a court order enjoining
calling. prerecorded calls are illegal under
federal law unless the consumer has an established
business relationship with the caller. beginning
september 1, 2009, the calls will not be legal
without express written signed consent from the
recipient of the calls. further, even if the
prerecorded call is allowed, it still must comply
with general restrictions against fraud and other
provisions of the telemarketing sales rule aka tsr
and other applicable law. given recent political
statements on this topic, you can expect the ftc to
be active in its enforcement of existing and new
provisions of the telemarketing sales rule.
06.19.09-(compliance news) the ftc has confirmed
that it maintains telephone numbers for the
purposes of receiving and reviewing inbound
telemarketing calls. a client of mine allegedly
violated the tsr based on a call to this number. I
would argue that it was not a business-to-consumer
call.

various jurisdictions for violations of tcpa in the
form of unsolicited fax transmission(s). many

failure to register and download ftc dnc lists.

announced>
yesterday the largest telemarketing fraud sweep
ever coordinated by the agency. tagged operation
"tele-phoney" the agency filed federal district
court complaints against deceptive telemarketing
operations along with other enforcement agencies
encompassing more than 180 cases accross the united
states and canada. in many of these actions federal
courts have temporarily frozen defendants assets
and suspended defendants operations. the breadth of
this sweep was incredible. it included more than 80
state law enforcement actions, criminal actions
against more than 90 defendants and additional
telemarketing fraud actions brought by canadian and
british authorities. it appears the ftc is serious.

serious scrub technology who identified a series of
errors in the ftc dnc list this month. ALWAYS
download the full dnc list, never the updated list.

numbers on the full list are not always present on

04.19.08-april (incomplete) totals are
in.....wachovia bank $144 million, walmart shopping
spree scam $28.2 million. that's over $170 million

01.05.08-(compliance news).....on january 4th, the
fcc issued its declaratory ruling stating that
prerecorded and autodialed telephone calls to
wireless numbers that are provided by a called
party to a creditor are made with the prior
“express consent of the recipient and thus do
not violate the tcpas bans on calling wireless
numbers using a prerecorded message or autodialer.
in the past, the fcc ruled that a consumer who has
provided his or her telephone number to a business
has consented to a call to that number absent
instructions to the contrary. this ruling both
updates that previous statement and specifies that
collection calls are no different than other calls
to wireless numbers where the consumer has provided
his or her telephone number with respect to
application of this section of law.
11.08.07-magazine seller will pay more than $7
million for violations of the ftc telephone sales

that's $14 million in the past two days. when will
the federal government get serious about
telemarketing compliance violations?
11.07.07-the
ftc announced today a
law enforcement crackdown on do not call violators
with six settlements totaling nearly nearly $7.7
million in civil penalties along with consent
orders. adt along with two of its' authorized
dealers, alarm king and direct security services
(dss) have agreed to pay $2 million, $25,000 and
$20,000 respectively. these are near records!
included on the honor roll were craftmatic,
ameriquest, and guardian communications for
pre-recorded message blasting. to date, $19,539,943
in fines and settlements since dnc legislation in
federal/state fines and settlements. if you aren't

11.07.07-in pennsylvania a pennsylvania bill has
been introduced in the senate (SB 1116) which would
eliminate the five year expiration period for a
consumer do-not-call request. telephone numbers
would remain on the list until no longer valid for
that residential or wireless telephone subscriber.
this same issue is being debated at a federal
level.

federal law (tcpa) mandates a written compliance
policy, is yours in place?
10.17.07-a professional plaintiff has obtained
rights to the telephone number 999-9999 which is
often used as a "place holder" in lists of
telephone numbers. if a predictive dialer or
prerecorded voice call is placed to that number,
the plaintiff then claims damages of $1,500 per
call under the tcpa (telephone consumer protection
act). you should avoid placing prerecorded or
predictive dialed calls to place holder numbers in

judgments against telemarketers in small claims
court. The article mentions other websites which
walk potential plaintiffs through tcpa claims. be
aware, not every professional plaintiff brings
valid claims appropriate for settlement. If you do
settle every claim, valid or not, you may become a

quarter fcc report summarizing complaints from
consumers during second quarter of 2006 rank tcpa
as one of the top complaints from wireless
subscribers. specifically, artificial pre-recorded
messages on their cellular lines without prior
consent and failure to honor do not call requests.
also, the ftc has many investigations with regard
to the telemarketing sales rule. abandonment
provisions limited to three percent abandonment per
day/per campaign are of particular note. another
one million dollar settlement from a debt collector
for violations! huge fines, huge settlements are
already taking place when you can qualify for safe
harbor! now is the time to review your compliance
protocols and get your house in order for the

angeles federal court judge for violation of the
dnc provisions by direct tv and their outsourced
telemarketing groups. the proposed fine and
penalties were much more! this is the proposed
settlement. the case was filed by the department of
justice at the request of the ftc for multiple
violations of dnc, that is, simply calling lots of
people who were on the ftc dnc list. got the
message? stop outsourcing, it's like trusting a
stranger with your life savings. get serious about
compliance this year or you will pay BIG! if you
don't have written dnc protocols, if you are not
abiding by all dnc provisions, you are a
criminal and will pay. mitchell can help, but you

news).....several inquiry calls regarding the use
of computerized dialers to call residential with a
prerecorded message. illegal, in all states!!!!!
plain and simple!!!!! any user of this equipment is
subject to multiple penalties with legal precedent
having been set by many regulatory authorities. the
use of any equipment to deliver a prerecorded
message is a violation of multiple provisions of
the federal telephone sales rule (unless you are an
approved state or local agency, school, government,
or police). stiff state and local penalties apply
too. california fines $500 per phone call
made by the dialer. translation-$500,000 fine for
only 1000 calls made by your dialer! (most dialers
will dial several thousand numbers weekly!) dialers
with prerecorded messages are a gross violation of
the law and aren't used by responsible businesses.
if your company has decided to become more
"tele-responsible" call mitch for a proven and

2006, increased and aggressive enforcement is
promised by the ftc and many attorneys' general.
2005 was the first full year with new dnc
legislation resulting in several successful
prosecutions by federal and state enforcement

vanished. seems telemarketing this year will be
more expensive with tough enforcement
activity by all authorities (federal/state/local).
criminals are still dialing with no regard to
the dnc rules and without federal registration
or knowledge of the dnc provisions. (do you have a
compliance procedures manual for inspection should
the authorities come through the front door
tomorrow? it's the law!) minimal success and
maximum liability is the end result. now is the
time to get your compliance procedures in order,
next learn how to become effective, and experience
consistent success at telemarketing. if you didn't

government lawyers monday asked the U.S. Court of
Appeals for the 10th Circuit to uphold the
constitutionality of the "do-not-call" list, saying
it is necessary to protect consumers' privacy from
unwanted telemarketing calls. judges have not
announced when they will render an opinion in the
case.
10.30.03-(update).....november 10th
is the next big day for the national dnc registry.
a federal court judge will rule on the
constitutionality issue. complaints averaging about
1000 daily to the ftc.
10.17.03-(used dialers).....several

10.16.03-(update).....over 15,000 complaints lodged
with the ftc so far! a federal court judge will
rule early november on the whether the list
violates the constitutional free-speech rights of

says the list is back in effect while the court
case continues! donotcall.gov
is open again accepting new registrations!
telemarketing groups may download the list again
starting 10.10.03. it is unclear when enforcement
can begin. since the law was in place, consumers
could possibly begin filing lawsuits immediately.
consumers will likely file complaints with their
states attorney general or initiate lawsuits
against telemarketers directly for $500 to $1500
per violation. more news expected next week.
10.05.03-(commentary).....mitchell
advisory regarding ftc national dnc registry. at
current, "the courts" have the ftc site locked
down, making it impossible to access the site. if
your organization acquired the dnc registry,
COMPLY! if not, plan to comply, !IMMEDIATELY!, when
possible. you were required, by law, to comply with
the registry by 10.01.03. many decided to wait a
day or two and may find themselves in violation of
the law over the past couple of weeks. the
businesses and individuals who fail to comply will
be made examples of, early on. if you expect to
skirt under the radar, you are sadly mistaken and
out of business soon. I URGE ALL BUSINESSES
INVOLVED IN TELEMARKETING ACTIVITY TO TAKE THESE
NEW LAWS SERIOUSLY, AND SUBMISSIVELY COMPLY,
